Terms of Service

These terms are an agreement between you and Berry VPN (“Berry”, “we”, “us”) for the Berry VPN app, the website at berryvpn.app and the service behind them (together, the “Service”). By using the Service you accept these terms and ourPrivacy Policy. If you don’t agree, please don’t use the Service.

1. Who can use Berry

You must be at least 18 years old, or the age of majority where you live if that is higher, and able to accept these terms. You are responsible for making sure that using a VPN is allowed where you are.

2. The Service

• Free: Berry is free to use with sessions of up to 30 minutes. You can reconnect as often as you like. Some servers are reserved for Premium.
• Premium: a one-time pass for a fixed number of days that removes the session limit and unlocks all servers and features such as Stay connected.
• Servers: the VPN servers are operated by independent third parties, not by Berry. Their number, locations, speed and availability change over time. We refresh the server list regularly, but we can’t guarantee that any particular server or country will be available.
• No guarantee of anonymity: a VPN encrypts your connection to the VPN server and hides your IP address from the sites you visit. It does not make you anonymous and does not protect you against every risk. See thePrivacy Policy for what server operators can see.

3. Acceptable use

You agree not to use the Service to:

• break any law that applies to you, or help anyone else do so;
• send spam, phishing or malware, or attack, scan or disrupt any network, system or person;
• infringe other people’s rights, including intellectual property and privacy rights;
• access material that exploits children, or any content that is illegal to access;
• overload, reverse engineer, resell or interfere with the Service or the servers it connects to, or get around its limits by automated means.

We may limit, suspend or end access for anyone who breaks these rules.

4. Premium passes and payments

• Premium passes are one-time purchases. They never renew automatically and nothing is charged when they end.
• Prices are shown in US dollars and paid in the stablecoin and network you choose. You pay any network (gas) fees, and you must send the exact amount of the selected coin on the selected network. Coins sent on the wrong network or to a wrong address may be lost and may not be recoverable.
• A quoted price is held for a limited time. A payment that arrives after that time is still credited.
• A pass bought in the app is added to that app’s account once the payment is confirmed. A pass bought on the website is delivered as a redeem code; the pass starts when the code is redeemed. A new pass adds to any Premium time you already have.
• Prices and the coins and networks we accept may change. Changes don’t affect passes you have already paid for.

5. Redeem codes

Each redeem code can be used once, on one account. Anyone who has a code can redeem it, so keep it private. Codes don’t expire. We can’t replace a lost code unless you can show us the order, for example with your receipt link. We may cancel codes that were obtained by fraud or offered for resale without our permission.

6. Refunds

Refunds are covered by our Refund Policy, which forms part of these terms. Nothing in these terms limits rights you have under consumer law that can’t be excluded.

7. Your anonymous account

Berry doesn’t require sign-up. Your account lives on your device through a secret token. If you uninstall the app or lose your device, we may not be able to restore your account or remaining Premium time, because we don’t know who you are. Unused redeem codes are not affected.

8. Our content

The Berry name, logo, app and website are ours or our licensors’. You may use the app for your personal use under these terms; you may not copy, modify or distribute it except as the law allows.

9. Changes and interruptions

We are always improving Berry and may add, change or remove features. The Service may sometimes be unavailable, for example for maintenance, because of the third-party servers, or because of network restrictions where you are.

10. Disclaimer

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, including that it will be uninterrupted, error-free, fast, or available in any particular country, or that it will achieve any particular result.

11. Limitation of liability

To the extent permitted by law, Berry is not liable for indirect, incidental or consequential losses, or for loss of data, profits or opportunity, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you.

12. Ending use

You can stop using Berry at any time by uninstalling the app. We may suspend or end access if you break these terms or if we have to for legal reasons. If we ever stop offering the Service, we’ll give notice in the app or on the website where we reasonably can.

13. Changes to these terms

We may update these terms. We’ll change the date at the top and, for significant changes, let you know in the app or on the website. If you keep using Berry after the changes take effect, you accept the new terms.
